地方性法规视角下的红色文献保护行业标准研究

摘要

红色文献保护工作应在良好的法律环境中开展。近年来，各地纷纷针对红色文化和资源制定地方性法规，为红色文献的利用传承提供了一定的法律保障，但在红色文献保护方面仍然缺少相应措施，法律保护力度较为薄弱。本文梳理了现行红色文化地方性法规，认为造成上述情况的原因有外因和内因之分，其中内因是红色文献保护工作没有形成完善成熟的理念和技术，缺乏行业标准规范。因此，本文解释了红色地方性法规和红色文献行业标准之间的关系，提出在文化、文物、档案类现有标准的基础上，结合实证研究，建立红色文献保护专用行业标准，为红色文化地方性法规的制定提供科学依据和技术支撑，为红色文献营造良好的法律保护环境。

Abstract

The protection of red literature should be carried out in a good legal environment. In recent years, local regulations have been formulated for red culture and resources, providing a certain legal guarantee for the use and inheritance of red literature. However, there is still a lack of corresponding measures in the protection and restoration of red literature, and the legal protection is weak. In this paper the author combs the current local laws and regulations of red culture, and believes that there are external and internal reasons for the above situation. The internal reason is that the protection and restoration of red literature has not formed a sound and mature concept and technology, and the industry standards and specifications are lacking. Therefore, the author explains the relationship between red local regulations and red literature industry standards, and proposes to establish special industry standards for red literature protection on the basis of existing standards for culture, cultural relics and archives, combined with empirical research, so as to provide scientific basis and technical support for the formulation of red culture local regulations and establish a good legal protection environment for red literature.
