摘要

地方档案立法是档案法规体系建设的重要内容,是推进地方档案治理法治化和规范化的法律支撑。以现行31部省级地方性法规为分析样本,地方档案立法呈现如下特征：法规名称形式多样,以“条例”居多;法规修改方式不一,以“修正”为主;法规体例结构多元,以“大而全”为准。上述立法尽管一定程度上保障了地方档案治理的有序推进,但也存在立法文本之间简单重复、立法语言和句式表达失范、立法目的未体现档案治理信息化、立法内容缺乏地方特色等问题。未来地方档案立法的完善,应当强化立法前审查和立法后质效评估以提升档案立法质量,加强《立法技术规范》学习以规范立法语言和句式表达,重塑立法目的条款以昭彰档案治理信息化目标,同时立足地方档案治理需要增设特色和创制性规定。

Abstract

Local archives legislation is an important content of the system construction of laws and regulations of archives, and the legal support to promote the legalization and standardization of local archives governance. Taking the current 31 provincial local laws and regulations as the analysis sample, the local archives legislation presents the following characteristics: the names of laws and regulations are diverse, most of which are "regulations"; the ways to modify laws and regulations are difference, mainly "amendment"; the structures of laws and regulations are diversified, taking "large and comprehensive" as the criterion. Although the above legislation ensures the orderly promotion of local archives governance to a certain extent, there are also some problems, such as simple repetition between legislative texts, anomie of legislative language and sentence expression, failure of legislative purpose to reflect the informatization of archives governance, lack of local characteristics of legislative content and so on. The improvement of local archives legislation in the future should strengthen the pre legislative review and post legislative quality and effect evaluation to improve the quality of archives legislation, strengthen the study of Legislative Technical Norms to standardize the legislative language and sentence expression, reshape the legislative purpose and provisions to show the informatization goal of archives governance, and add characteristics and creative provisions based on the needs of local archives governance.
