我国境外企业档案管理的困惑和思考

摘要

随着贸易全球化,我国企业在境外设立的机构形成了大量的境外档案。在世界各国日益关注信息安全、加强合规管控的情况下,探讨我国对境外企业档案的规范管理成为紧迫的问题。本文就我国境外企业档案管理工作中面临的几个基本问题,如境外企业的法律身份、境外企业档案适用的管理规则、合规风险下境外企业档案管理中应关注的核心问题等展开讨论,以期能够厘清企业境外档案管理中的困惑,避免给企业境外档案管理带来合规风险。

Abstract

With the trade globalization,the institutions established by Chinese enterprises abroad have formed a large number of overseas archives. Under the circumstances that the world are paying more and more attention to information security and strengthening compliance control,it is an urgent issue to discuss the standardized management of overseas enterprises’archives. This paper discusses several basic issues in the management of overseas enterprises’archives,such as the legal identity of overseas enterprises,the applicable management rules for overseas enterprises’files,and the core issues that should be concerned in the management of overseas enterprises’files under compliance risks. This paper is aimed at clarifying the confusion in the management of overseas archives,and avoiding the compliance risk of overseas archives management.
