综合档案馆个人信息保护的多元主体共治模式研究

摘要

综合档案馆作为信息资源典藏机构，在个人信息保护方面担负重要责任。伴随《中华人民共和国个人信息保护法》等法律的实施，多元主体共治成为综合档案馆个人信息保护的关键方向。档案形成者、档案利用者、行政监管者、数据部门、社会力量是参与综合档案馆个人信息保护的重要主体，既相互关联又职责各异。为实现有效共治，需分别构建“前控型”协作保护模式、“回应型”合作互信模式、“合作型”协同共治模式、“互鉴型”协同互惠模式、“参与型”协作共治模式。多元主体共治模式为综合档案馆个人信息保护提供了系统的实践路径，助力推动档案事业在个人信息保护领域的高质量发展。

Abstract

As an information resource collection institution, the comprehensive archives bear important responsibilities in the protection of personal information. With the implementation of laws such as the Personal Information Protection Law of the People's Republic of China, multi subject co-governance has become a key direction for the protection of personal information in comprehensive archives. records creators, archive users, administrative regulators, data departments, and social forces are important entities involved in the protection of personal information in comprehensive archives, which are interrelated and have different responsibilities. To achieve effective co governance, it is necessary to establish front-end control collaborative protection mode, collaborative mutual trust mode, collaborative governance mode, reciprocal governance mode, and participatory governance mode separately. The multi subject co-governance model provides a systematic practical path for the protection of personal information in comprehensive archives, helping to promote the high-quality development of the archival industry in the field of personal information protection.
