大数据时代档案数据权利治理研究

摘要

大数据时代，档案数据成为档案信息资源的新形态和档案管理的新场域，档案数据治理日渐兴起。数据确权是档案数据治理的重要内容，数据归属不清、权责不明、公私冲突、伦理安全、知识产权维护等问题掣肘档案数据开放共享与价值释放，开展档案数据权利治理势在必行。本文立足档案数据生态境况与管理实践，分析档案数据权利保障的困境障碍，揭示档案数据权利治理内涵质性与功能坐标；借助传统哲学思想“道法术器势”理论体系，从理念、方法、行动、工具、态势等层面系统构筑档案数据权利治理路径，健全档案数据权利制度规则与保障机制，塑造档案数据运行秩序新生态，助力档案数据治理现代化。

Abstract

In big data era, archival data has become a new form of archival information resources and a new field of archival management, and archival data governance is rising day by day. Data right determination is an important content of archival data governance. Problems such as unclear data ownership, unclear rights and responsibilities, conflicts between public and private, ethical security, and intellectual property rights maintenance restrict the open sharing and value release of archival data, so it is imperative to implement archival data rights governance. Based on the ecological situation and management practice of archival data, this paper analyzes the difficulties and obstacles in the protection of archival data rights, and reveals the connotation and functional coordinates of archival data rights governance. Tao spell is potential with the help of traditional philosophy theory system, from the concept, method, action, tools, situational different level, such as the system construction of archival data rights governance path. Setting up a sound system of archival data rights rules and safeguard mechanism, new ecological shape archival data operation order, help archival data governance modernization.
