单轨制视角下国内外电子文件证据立法研究

摘要

研究通过梳理国内外电子文件证据立法的类型、内容、程序及司法实践,分析了国内外电子文件证据立法的内容特点及其启示,探讨了电子文件单轨制管理模式下我国电子文件证据立法现状及问题,并从电子文件证据的概念界定、法律定位、证明力和司法程序、立法规则等方面对单轨制模式下我国电子文件证据立法提出了对策建议。

Abstract

：By sorting out the types, contents, procedures and judicial practices of electronic record evidence legislations at home and abroad, this paper analyzes the characteristics, contents of the electronic record evidence legislations, discusses the current situation and problems of the electronic record evidence legislations under the single-track mode of electronic record management in China and provides some suggestions to the lawmaking of electronic record evidence in China under the single-track system from the concept definition of electronic record evidence, legal position, probative force, judicial procedures and legislative rules.
