我国档案管理地方立法研究——基于66部地方性法规的实证分析

摘要

推进档案管理法治化进程需要健全完善的地方立法体系。截至2018年12月,我国共出台档案管理地方性法规66部,呈现出制定主体覆盖面广,制定时间跨度较大,制定模式体例多样等特征。上述立法虽在一定程度上保障了地方档案管理的有序开展,但毋庸讳言,目前也存在着部分立法已难以适应当前档案管理的新要求,部分条款操作性不强、严谨性不够等问题。当前,应按照新时代档案管理的新需要和科学立法的新理念来制定和修订档案管理地方性法规。

Abstract

Promoting the process of legalization of archives management requires a sound and perfect local legislative system. As of December 2018, 66 local laws and regulations on archives management have been issued in China, showing the characteristics of wide coverage of the main body, long time span, and various formulation modes and styles. Although the above-mentioned legislation has guaranteed the orderly development of local archives management to some extent, there are still some problems such as difficult adaption to the new requirements of current archives management, lack of operability and rigidity in some provisions. At present, local regulations on archives management should be formulated and revised according to the new needs of archives management in the new era and the new ideas of scientific legislation.
