香港特区政府信息公开制度：高度透明与立法缺位

摘要

构建香港特区政府信息公开制度的核心规则是不具有法律拘束力的《公开资料守则》。现实中政府信息公开制度在香港得到了良好的实施：公民大部分政府信息公开申请均被满足,申诉专员对公民知情权提供有力救济。内部利益吸引和外部制度制约是政府信息公开制度实施的核心要素;司法救济的缺失应归责于法院的过度保守而并非政府信息公开法的缺位。内地完善政府信息公开制度应当充分利用政府信息公开制度提升政府形象,完善政府信息公开制度监督和评议制度。

Abstract

The core rule of government information disclosure system in Hong Kong is the Code on Access to Information that is not binding .However, the government information disclosure system is well implemented in Hong Kong, and most public citizens' applications for public information are fulfilled. As for the right to know, the ombudsman can provide citizens with effective relief. By analyzing the paradox, we can draw the conclusion that internal interest attraction and external system restriction are the core elements of the government information disclosure system. The lack of judicial relief should attribute to the excessive conservativeness of the court rather than the absence of the government information disclosure law. In order to improve the system of government information disclosure in mainland China, we should make full use of the government information disclosure system to enhance the government image,and improve the system of supervision and appraisal for the government information disclosure system.
