论《档案法》中法律责任制度的完善—— 以112件档案违法违纪案例为样本

摘要

《档案法》实施30年以来的112件档案违法违纪案例显示,《档案法》对于法律责任的制度设计比较科学;同时,也存在档案违法行为的设置应该进一步完善的问题。针对该问题,提出完善《档案法》中法律责任制度的5个建议：科学设置档案违法行为、完善档案行政责任制度、加强档案行政责任与档案刑事责任之间制度衔接、科学表述档案民事责任、协调《档案法》与其他法律中同一违法行为的法律责任。

Abstract

Through analyzing 112 archival cases of violation of law and discipline,the article considers that the legal liabilities of Archives Law of the People’s Republic of China is relatively scientific. On the other hand,there are some problems in the legal liabilities of Archives Law. This paper proposes 5 suggestions to perfect the archives legal liabilities: enactment the illegal act; perfect the administrative liabilities; perfect the civil liabilities; perfect the the criminal liabilities and keep consistent and harmonious with related department laws.
