破产企业档案管控：两类制度共性程序规则的设置及其保障路径

摘要

破产程序中的企业档案受到档案行政管理和破产民商法两类制度的同时调整，只有实现管理责任人、管理工作流程和管理费用三项共性程序性规则的同频规制，才能保障破产企业档案在两类制度共同运作的程序中实现同步处置的管控目的。本文分析了我国破产企业档案管控制度演进中，这两类制度设置共性程序性规则的得失以及各自存在的规范差距，提出完善《破产法》和档案行政管理制度对破产企业档案进行调整的共性程序规则、设置档案行政管理机构参与破产处置程序等路径，为破产企业档案管控提供制度保障。

Abstract

Enterprise archives in bankruptcy proceedings are simultaneously adjusted by the two systems of archivesadministration and bankruptcy civil and commercial law. Theco-frequency regulation of the three common procedural rules, namely, management responsible person, management workflow and management expenses, can guarantee the control purpose of synchronous disposal of bankrupt enterprise archives in the process of the joint operation of the two systems. This paper analyzes the gains and losses of setting common procedural rules in these two systems and their respective normative gaps in the evolution of China's bankruptcy enterprise archives control system, and puts forward some paths such as perfecting the common procedural rules of the Bankruptcy Law and the archives administration system to adjust the archives of bankrupt enterprises, and setting up archives administration agencies to participate in the bankruptcy disposal procedures, so as to provide institutional guarantee for the archives management and control of bankrupt enterprises.
