档案行政诉讼裁判结果影响因素研究——基于342份司法裁判文书的实证研究
Research on the Influencing Factors of the Judgment Results of Archival Administrative Litigation：An Empirical Study Based on 342 Judicial Documents

摘要
行政诉讼日益成为解决公民、法人等与档案主管部门之间争议的主要途径，构成当事人权益保护的重要制度保障。本文基于2000年以来342份档案行政诉讼裁判文书进行实证研究，讨论我国档案行政诉讼的发展趋势及主要特点，并进一步分析考察档案行政诉讼裁判结果的影响因素。结果表明：法院级别、被告级别、原告有无聘请律师、原告是否提供证据、被告是否含有档案馆与裁判结果存在显著的相关关系。本文基于上述研究结果为完善档案行政诉讼制度和档案管理制度提出对策：未来应当加大对原告的保护力度，完善档案行政复议制度，健全档案行政诉讼证据制度，明确档案行政诉讼受案范围和档案主管部门职责，深化档案主管部门服务职能。

Abstract
Administrative litigation has increasingly become the main way to resolve disputes between citizens or legal persons and archives competent departments, which is a key institutional guarantee for the parties' rights and interests. Based on 342 adjudication documents of archival administrative litigation since 2000, this paper discusses the development trend and main characteristics of archival administrative litigation in China, and further analyzes the factors that affect adjudication results of archival administrative litigation. The research shows that the judgment result is significantly correlated with the court level, the defendant level, whether the plaintiff has hired a lawyer, whether the plaintiff has provided evidence and whether the defendant contains archives or not. Based on the above research results, a series of countermeasures are put forward to improve the archives administrative litigation system and the archives management system: the protection of the plaintiff should be strengthened, the system of archival administrative reconsideration and the system of archival administrative litigation evidence should be improved, the scope of accepting cases of archival administrative litigation and the responsibilities of archives competent department should be clarified, and the service functions of archives competent department should be deepened.
