行政复议体制改革对档案行政管理工作的挑战及对策研究

摘要
中央全面依法治国委员会制发了《行政复议体制改革方案》,要求整合地方行政复议职责,除少数几个领域外,由本级人民政府统一行使行政复议职责。本文收集了全国范围内的30件行政复议案例,全面系统总结了档案行政复议案件基本情况和主要特点,分析了档案行政复议体制改革将会对档案行政管理工作带来的挑战,结合新修订的《档案法》,提出档案主管部门进一步提高依法行政水平的对策。
Abstract
The programme for the administrative reconsideration system reform was constituted by Central Committee for the Comprehensive Administration of State affairs in accordance with law to integrate the function of the administrative reconsideration. The government exercises the function of administrative reconsideration except some working fields. This research has selected 30 archival administrative reconsideration cases around the country. This research summarizes the characteristics of archival administrative reconsideration cases, analyzes the challenges and proposes a number of suggestions to enhance the level of law-based administration.
