企业敏感档案跨境管理的合规风险

摘要

遵守档案所在国家和地区的管理规定是企业跨境管理档案的前提。但近年来随着国家间竞争加剧,国际贸易形势恶化,各国对商业、技术等信息的管制越发严格,管制规则也越发难以协调,企业跨境管理档案面临着严峻的合规风险。基于此,本文分析了涉及企业商业秘密、专利技术和个人信息等敏感档案的跨境管理,尤其是跨境转移时应注意的合规问题,以期避免企业档案跨境管理和转移时的违规风险。

Abstract

：Complying with the management regulations of the countries and regions where the archives are located is the prerequisite for enterprises to manage cross-border archives. However, in recent years, as competition among countries has intensified, the international trade situation has deteriorated. The stricter the regulation of information on business and technology in various countries, the more difficult it is to coordinate. Enterprises cross-border archives management is facing serious compliance risks. Based on this, the article analyzes cross-border archives management issues involving sensitive files such as business secrets, patented technology and personal information, especially the compliance issues that should be paid attention to in order to avoid the risk of violations in cross-border archives management and transfer.
