摘要

随着公民民主权利意识和利用需求的提高,档案开放利用的宏观环境已然发生了重大变化。自国家档案局启动档案法修订工作以来,档案开放利用成为学界和社会各界关注的热点问题。我国档案法律法规在开放利用政策规定方面尚有需要完善之处。本文基于比较研究法选取六个具有代表性的国家档案法律法规中涉及开放利用政策的规定,从主体界定、开放利用内容、开放利用程序和法律救济途径四个方面进行调查分析,并与我国法律法规的有关规定作出对比,进而提出完善我国档案开放利用政策的建议,为学术界深化档案开放利用政策研究和立法者修订档案开放利用政策提供参考。

Abstract

In China, with the improvement of citizens' awareness of democratic rights and the need of utilization, the macro environment of open utilization of archives has changed greatly. Since the National Archives Administration of China initiated the revision of the Archives Law, the opening and utilization of archives has become a hot issue in the academic and social circles. there are still some shortcomings in the laws and regulations on the archival opening and utilization. This paper has based on the comparative approach and selected representative policies of archival opening and utilization from six countries' archival laws and regulations, and has done a full investigation and analysis around the definition of main subject, the content of opening utilization, the procedures of opening utilization and the legal remedy channels. Comparing with the relevant laws and regulations of China, the author tries to put forward some suggestions to improve our country's policy of archival opening and utilization, and provide a reference for the academic community and legislators to deepen research and revise the policy of archival opening and utilization.
