档案行政执法的规范程序建构—— 兼谈《档案法》第16条第1款的行政行为属性

摘要
新的《中华人民共和国档案法》已于2020年6月20日修订通过,并将于2021年1月1日起正式施行。从目前公布的新法律文本来看,此次修法对现行《中华人民共和国档案法》作出了大量的修改,对档案的科学管理具有明显的进步意义,但其对档案行政管理部门进行赋权时,未对相应的执法程序做出更为明确的规定。因此在新法即将施行之际,有必要进一步明晰档案行政执法各行为的属性和程序,真正实现依法行政、依法治档的目标。
Abstract
The new Archives law of the People’s Republic of China has been revised and passed on June 20, 2020. This law will come into effect on January 1, 2021. According to the new legal texts, it has made a lot of amendments to the current Archives Law of the People’s Republic of China, which has obvious progressive significance for the scientific management of archives. However, when it empowers the archives administrative departments, it does not make more explicit provisions on the corresponding law enforcement procedures. Therefore, when the new law is about to be implemented, it is necessary to further clarify the attributes and procedures of archives administrative law enforcement, so as to truly achieve the goal of archives administration according to law.
